The Florida Board of Education decided Tuesday not to appeal two legal actions that hadn’t gone their way — one barring the state from charging out-of-state tuition to the children of illegal immigrant residents, the other tossing out the rule implementing new teacher evaluation rules.

The first action means that those college and university students will be able to pay in-state tuition beginning with the spring 2013 semester.
The second has fewer implications, in that the law imposing new evaluation requirements still is in place. The board already has thrown out the invalidated rule and begun drafting a new one that will tie student test results to teacher evaluations. Department of Education spokeswoman Cynthia Sucher said on Twitter that board members made clear their support for improved teacher evaluations.
